Yes, you are disqualified, and it is too late to get divorced, the divorce has to be final, not simply filed for.

True. If married, both spouses must meet the qualifications in the law even if separate tax returns are filed.

if your husband has owned a home in last 3 years while you were married to him then you do not qualify.

If your name is not on the title or mortgage, I think you still qualify as a first time homebuyer. Just be sure you don't mention your husband or previous house on the application. And of course you'll need to qualify for the loan on your own income.

As long as you are not listed on the title to your present house and your possible-soon-to-be ex is not listed on the title to your new house, you should be okay.

Get divorced! Or put your marriage back together. You don’t qualify currently.
