Can someone help me with a problem we're having with a car dealer?
Back at the very beginning of April, my husband and I traded in our old 2002 Dodge Grand Caravan at the same dealership we purchased it from a couple of years ago and we bought a newer minvan. We still had about 10 months worth of payments left on our Dodge when we traded it in, but the dealership said that they would send in a payoff to our finance company. The dealership even called our finance company to find out the exact payoff amount for our old van. They did that right in front of us. Plus, we put a down payment of $1000 down on our new van. Well, fast forward 2 months to this past weekend, we received a letter in the mail saying that we were behind on our payments on the Dodge. We knew that this was impossible since we traded that van in 2 months ago and the dealership sent them a payoff for what we still owed on it, which was a little over $3000. I got right on the phone and called the car dealership and I actually spoke with the salesman who sold us our new van and took our trade in. He remembered us and he said that they had sent in a payoff on our old Caravan when we traded it in and he had no idea why the finance company would have sent us a letter saying that we were in default when that loan had been all paid off. The salesman told me not to worry and that he would call the finance company first thing on Monday (which is now today) and get it all taken care of. I asked him if we should call the finance company and he said no and that he would call them today and call us back as soon as he spoke with them.

By around 1 PM today when we hadn’t heard anything, I called the dealership back and got a different person and had to explain the whole situation again. He told me that he would have the manager look into this and that someone would call me back in about 20 minutes. While I was waiting, I decided to call the finance company myself to see what they had on their records. According to them, they never received the payoff from the dealership and our account was still open and was in default. They told me that they needed the dealership to mail them a check for the payoff amount.

I waited about another hour for someone from the dealership to call me back, but they never did, so I got back on the phone and called them and got another different person and had to explain the whole thing AGAIN!!! This guy said the same thing, that he would bring this to the attention of the manager and have someone get right back to me. Well, the dealership is now closed for the day and they never got back to me. What do we do???? I don’t want this to have a negative effect on our credit reports because of the dealership’s major screwup! We are in the middle of refinancicing our house! I need some advice ASAP! I’m going to have to deal with this again tomorrow!
I just got an email from the manager of the dealership a couple of minutes ago and he said that it has all been taken care of and they will correct and discrepanices and they already took care of the payoff amount. Hopefully this will be the end of this mess!

remain calm, continue to ride the dealership and im sure they will pay the van off in full, at that point you may want to pull your credit report and if there is anything negative from this deal on there you will have to dispute it. Im sorry to say but that is about all you really can do. if they havnt found some sort of resolve for this by tomorrow then I would let them know they have until the end of the week before you have a lawyer involved. its obvious that the dealer screwed up and im sure they will fix it but its sad that it is on your time and your credit.

Ask to speak to the Accounting Office regarding the issue… They made the mistake… And with proof that you traded the car it will not effect your credit you can appeal that..Also see if your old van is still there.. they can not sell it untill it is payed off it could be a mistake on the finance company
